Speech act is one of the terms of linguistics and philosophy of language, which refers to an action that occurs as a result of an intentional statement or speech, and the speaker has a purpose for expressing that part of speech. Since the examination of speech acts in religious texts, especially in the Qur'an and Nahj al-Balagha, is one of the ways to understand the hidden layers of speech and to know the effect of the origin of the speech, in this research we seek to use From Searle's speech act theory, with analytical-descriptive study, to compare the speech acts used in Surah Toba with the speech acts of the 52nd sermon of Nahj al-Balaghah. Since most of the verses of Surah Towbah are in the sub-branch of declarative action, so declarative action is used more than other actions in Surah Towaba. In the 52nd sermon of Nahj al-Balaghah, like Surah Toba, because the general nature of the sermon is to describe the world and its ephemerality, the declarative action is the most used. In Surah Towba, the obligatory verb is used the most, and in the 52nd sermon of Nahj al-Balagha, the persuasive verb is the most used after the declarative verb. In both Surah Toba and khutbah 52 of Nahj al-Balagha, declarative action is the least used. According to the results obtained from the 229 speech acts used in Surah Towbah and the 52nd sermon of Nahj al-Balaghah, it showed that there is a significant difference in the types of speech acts used in the translation of Surah Towbah and Nahj al-Balaghah based on Searle's model. The first and fourth sub-hypotheses of the research were rejected. Because both in Surah Towbah and khutbah 52 of Nahj al-Balagha, the declarative action was the most used and the declarative action was the least used. The second, third and fifth hypotheses were confirmed. Because according to the Chi test, there is a significant difference in the commitment, persuasive and emotional actions used in Surah Towbah and the 52nd sermon of Nahj al-Balagha.
