fa بررسی فقه الحدیثی روایت «اسْتَعْمَلْتُمُوهُ حَتَّی إِذَا کَبِرَ وَ عَجَزَ مَنَعْتُمُوهُ‌ أَنْفِقُوا عَلَیْهِ مِنْ بَیْتِ الْمَالِ» A review of hadith jurisprudence on the narration of "Use it even if greatness and infirmity prevent it from spending on it from the house of wealth" تخصصي Special پژوهشي Research سالمندان، نیازمندی‌ها، شرایط، استعدادها و توانایی‌های مختلفی دارند. جامعه‌ای سالم و صالح‌ است، که برای تمام اقشار با توجه به شرایط و خصوصیات آنان، حقوق و احکام متفاوتی وضع کند، مخصوصا سالمندان که روزی جامعه را ساخته‌اند ولی امروز از نظر جسمی ناتوان شده‌اند؛ لذا باید به عنوان مهمترین قشر، به آنان رسیدگی شده و حکومت به واسطه خدمات و زحمات این افراد، باید حقوقی مختص ایشان وضع‌کند. در این مقاله با بررسی فقه‌الحدیثی روایت «ابی حمزه عن رجل بلغ به علی بن ابی‌طالب؟ع؟قال:مرشیخ مکْفوف کبیر یسأل فقال علی بن ابی‌طالب؟ع؟مَا هَذَا؟فَقَالُوا یَاأَمِیرالْمُؤْمِنِینَ؟ع؟نَصْرَانِیٌّ!فَقَالَ علی بن ابی‌طالب؟ع؟اسْتَعْمَلْتُمُوهُ حَتَّی إِذَاکَبِروعَجَزَ مَنَعْتُمُوهُ&rlm;؟!أَنْفِقُوا عَلَیْهِ مِنْ بَیْتِ الْمَالِ.» به بررسی حقوق سالمندان در جامعه اسلامی پرداخته شده است. این مقاله به روش توصیفی و تحلیلی با بهره‌گیری از منابع کتابخانه‌ای وبا بررسی آیات و روایات و تشکیل خانواده حدیثی مشخص شد که با وجود اینکه این روایت مرسل است ولی روایات متعدد دیگری در تأیید آن وارد شده‌است و مجموعه این اخبار و ادله اثبات می‌کند که باید حقوق خاصی برای این افراد در نظر گرفته‌شود اما این حقوق محدودیت خاص خود را دارد.   <table> <tbody> <tr> <td title="تعداد کلمات: 182">The elderly have different needs, conditions, talents and abilities.
