Analysis of The Verdict of Istirqaq (Enslave Prisoners of War) Based on Verses And Hadiths

The issue of slavery is one of the most important and challenging issues. At the time of the advent of Islam, slavery was practiced in various ways. Islam closed all channels of slavery and only considered taking prisoners of war valid. This article examines the issue of Istirqaq in the sources of jurisprudence in an analytical way and after looking at the verdict of prisoner of war in verses and hadiths, reports the views of some jurists regarding the Istirqaq of prisoners of war.
The result of this research is that in the verses, narrations, as well as in the biography of the Prophet Muhammad and the Imams, there is no defensible reason for enslaving warriors or other slaves. The enactment of the rulings of slaves is certainly not accepting slavery, but in the first stage due to the prevalence of this custom, it was imposed on the new Muslim society, and in the next stage it is to correct the miserable situation of slaves in society and to liberate them. |
